1.1 UCL Institute of Education Press (UCL IOE Press) is an academic press which is part of the UCL Institute of Education. Its legal address is 20 Bedford Way, London WC1H 0AL.
1.2 Please read these terms and conditions carefully before using this website to purchase products (“Products”). By using this website to purchase Products, you agree that these terms and conditions apply.
2.0 Contract terms
2.1 By ordering Products, you confirm either:
- that you are doing so in your personal capacity and that you accept that these terms and conditions will apply; or
- where you are ordering a Product in the name of another individual, a partnership, company, or other legal entity, that you have the right and authority to do so and to accept these terms and conditions on behalf of such individual, partnership, company or other legal entity.
3.0 Ordering Products
3.1 It is your responsibility to ensure that all details of each order you place are complete and accurate.
3.2 Each order will be an offer by you to purchase Products subject to these terms and conditions. UCL IOE Press will not be bound to supply any Products ordered until it has accepted the order by email or otherwise notified its acceptance to you. UCL IOE Press is entitled to reject any order and, if it does so, it will notify you.
4.0 Prices and payment for Products
4.1 The price for a Product is the price in force on the date and at the time of ordering. UCL IOE Press tries to ensure that the prices displayed on this website are accurate but prices are subject to validation by IOE Press as part of its acceptance procedure. UCL IOE Press will inform you prior to acceptance of your order and/or booking if the correct price of a Product is higher than that stated in your order and in such a case you may cancel the order if you wish.
4.2 Payment for the total cost of the Product together with any applicable delivery charges must be made via PayPal at the time of order and/or booking. Any credit or debit card used to purchase Products must belong to you or be used with the consent of the owner and there must be sufficient funds or credit available to cover the cost of any Products. UCL IOE Press reserves the right to obtain validation of any credit or debit card details or verification of the authenticity and ownership before accepting any order or supplying any Products. Users of PayPal will also be subject to PayPal’s user agreement.
5.0 Delivery of Products
5.1 Once an order has been accepted by UCL IOE Press, UCL IOE Press will aim to deliver the Products by the date stated in the acceptance of order or, if no date is stated, within a maximum of 30 days beginning with the day after the date of your order. The Products will be delivered to the place specified in the order.
5.2 All times or dates for delivery stated on this website are estimates only. UCL IOE Press will make all reasonable efforts to deliver Products within the time specified but does not accept liability for any failure to deliver within that time.
5.3 If an order is made for a product that is not yet published at the time of order (a pre-order), that order will be held on record until the product is ready for despatch. UCL IOE Press will be in touch with the customer to give a likely availability date. The customer agrees that by pre-ordering a title, they are happy to pay in advance and wait until the product arrives.
6.0 Returns of Products
6.1 If the Product delivered is not as you ordered, or is not of satisfactory quality or fit for any particular purpose specified on this website, UCL IOE Press will at its option deliver a replacement Product or refund to you the price paid and your reasonable costs of returning the Product.
6.2 Save as set out above, Products may be returned within 14 working days commencing the day after delivery. To return Products, you must notify UCL IOE Press in writing (by post, e-mail or fax at the addresses and/or number given in the confirmation e-mail) within such period of 14 working days and you must arrange for and pay the cost of returning the Products to UCL IOE Press. UCL IOE Press will refund the sum that you paid for the original supply and delivery of the Products as soon as possible, but in any event within 30 days of you notifying IOE Press that you are returning the Products.
6.3 All Products which you intend to return must be kept in good condition whilst in your possession.
6.4 Where the returns policy in respect of a Product differs from the terms stated above, this will be made clear prior to ordering.
7.1 UCL IOE Press warrants that the Products will correspond with their descriptions as set out on this website and, save to the extent that any defects are drawn to your attention before acceptance of your order, will be of satisfactory quality.
7.2 UCL IOE Press gives no warranty that making the Products available in any particular jurisdiction outside the United Kingdom is permitted under any applicable non-United Kingdom laws or regulations. Accordingly the Products or any part of them are not offered for sale in any jurisdiction or to any customer where making those Products available is prohibited, whether by reason of nationality, residence, age or otherwise. If you are resident outside the United Kingdom you must satisfy yourself that you are lawfully able to purchase the Products.
7.3 All other express or implied terms, conditions, warranties or representations whatsoever with regard to the Products provided through this website, or any information provided by IOE Press through this website, are excluded to the fullest extent permitted by law.
8.0 Exclusions and limitations of liability
8.1 Nothing in these terms and conditions shall exclude or restrict the liability of IOE Press for death or personal injury resulting from negligence or for fraudulent misrepresentation or in any other circumstances where liability may not be so limited under any applicable law.
8.2 Subject to the paragraph above, UCL IOE Press shall not be liable, whether in contract, tort, negligence, breach of statutory duty or otherwise for loss of data, profit, revenue, use, business, anticipated savings, goodwill, reputation or opportunity, financial or economic loss or any indirect or consequential loss or damage, costs or expenses whatsoever or howsoever arising out of or in connection with the sale and supply of Products or the purchase or attempted purchase of the Products by persons in jurisdictions outside the United Kingdom.
8.3 Subject to the two paragraphs above, the total liability of UCL IOE Press, whether in contract, tort, negligence, breach of statutory duty or otherwise, for any loss or damage, costs or expenses arising out of or in connection with the sale and supply of any Product, shall not exceed the amount paid for the Product concerned.
8.4 If the limitation on the liability of IOE Press set out in the preceding paragraph is adjudged to be unreasonable in the circumstances, the limit of the liability of UCL IOE Press shall be increased to the amount that IOE Press can recover from its insurer for the loss in question.
9.1 The failure or delay by either party to exercise or enforce any right or remedy under these terms and conditions shall not operate as a waiver of that right or remedy.
9.3 UCL IOE Press will not be deemed to be in breach of these terms and conditions or held liable to the customer for any delay in performance or failure to perform any of its obligations to the customer to the extent that such delay or non-performance is due to any cause beyond UCL IOE Press’s reasonable control.
9.4 No person who is not a party to the contract between UCL IOE Press and you shall have any right to enforce any term or condition of it.
9.5 If any provision or term of these terms and conditions shall become or be declared unlawful, invalid or unenforceable, in whole or in part, for any reason whatsoever, such provision or term or such part of it shall to that extent be severed from the remaining terms and conditions and deemed to be deleted from them as far as possible without modifying or affecting the legality, validity or enforceability of the remaining terms and conditions, which will remain in full force and effect.
9.6 These terms and conditions shall be governed by and construed in accordance with English law and any dispute arising out of the supply and purchase of the Products shall be subject to the exclusive jurisdiction of the English Courts.
